TERMS & CONDITIONS
 
1. Information on How To Enter forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to Australian residents. Employees (and their immediate families) of the Promoter and the agency associated with this promotion are ineligible to enter.
3. Promotion commences 09.01 am AEST on 15/02/2011 and closes 11.59 pm AEST on 31/05/2011 ("the Promotional Period"). All entries for the Prize Draw must be received during the Promotional Period. 
4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. If there is a dispute as to the identity of an entrant or the prize winner, the Promoter reserves the right, in its sole discretion to determine the identity of the entrant or prize winner.
5. Incomplete, indecipherable, or illegible entries will be deemed invalid.
6. There is a limit of one entry per person per day over the promotional period.
7. Entrants must retain their original purchase receipt(s) as proof of purchase. Failure to produce the proof of purchase when requested may, in the absolute discretion of the Promoter, result in invalidation of the entrant's entry and forfeiture of any right to the prize. Purchase receipt must clearly specify the place of purchase, the product purchased and that the purchase was made during the promotional period but prior to entry.
8. The Promoter's decision is final and no correspondence will be entered into.
9. Prize Draw: The prize draw will take place on 03/06/2011 at 3.00pm AEST at Sue Ismiel & Daughters Pty Ltd Head Office, Suite 402, Lakeside Corporate Centre, 29-31 Solent Circuit, Baulkham Hills NSW 2153. The winner will be notified by phone and email and published in The Australian on 08/06/2011.
10. The first valid entry drawn will win a 3 night Spa Package for two adults at Qualia Resort on Hamilton Island, Queensland valued at $5,000. The prize package must be booked through the Promoter’s travel agency within 3 months and taken within 12 months. The prize package includes: (a) Return economy air fares to Hamilton Island from the winner’s nearest Australian capital city and VIP transfers from Hamilton Island airport/marina to Qualia Resort. Economy airfares are based on 21-day advance purchase fares, exclude special event loadings, and are subject to booking & flight availability & the tour operators terms & conditions; (b) Accommodation at Leeward Pavillon and is based on twin share; (c) Full breakfast, dinner & non-alcoholic beverages at Long Pavilion or Pebble Beach daily; (d) A Bularri Yarull 90 minute Warm Stone Massage per adult; (e)VIP chauffeur service plus 1 x two seater golf buggy; and (f) Beach drop-offs to selected local beaches on surrounding islands. The prize package excludes insurance, taxes or levies, spending money, transport costs to point of departure, & any other ancillary costs. No responsibility is accepted for any variation in the content or value of the prize package (which is dependent on point of departure).                                 

                   



11. The prize package is not transferable or exchangeable and cannot be taken as cash.                                             
12. Judges’ decision is final and no correspondence will be entered into.
13. In the event the winner is under the age of 18 years, the prize will be awarded to their nominated parent or guardian.
14. If the prize is unclaimed a draw will take place at 3.00pm AEST on 23/09/2011 at the same place as the original draw, to award the prize, subject to any directions from a regulatory authority.
15. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
16. Total prize value is up to AUD$5,000.00 (including GST)
17. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
18. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) To disqualify any participant; or (b) Subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
19. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) Any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) Any theft, unauthorised access or third party interference; (c) Any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) Any variation in prize value to that stated in these Terms and Conditions; (e) Any tax liability incurred by a winner; or (f) Use of the prize.
20.The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, its agency & prize supplier and, as required, to regulatory authorities. Participation is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes without any further reference, payment or compensation to the entrant or prize winner. Participants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
